These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and VerifyNumber ("VerifyNumber," "we," "us," or "our"). They govern your access to and use of verifynumber.io, the VerifyNumber applications, the VerifyNumber API, and any related services (collectively, the "Service"). By creating an account, purchasing credits, or otherwise using the Service, you accept these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that your use will not violate any law applicable to you.
2. The Service
VerifyNumber provides temporary phone numbers, backed by real carrier eSIM infrastructure, that allow you to receive SMS verification codes for online services. A number is assigned to your session for a limited time window and may be returned to our rotation pool after that window closes. Numbers are provided on an as-available basis and specific numbers or regions are not guaranteed.
VerifyNumber is not a telecommunications carrier and does not provide voice calling, outbound messaging, emergency services, or permanent phone numbers. The Service is intended for one-time verification workflows, not as a replacement for personal or business telephony.
3. Accounts
To access certain features, you must create an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of any suspected unauthorized use. You are responsible for all activity that occurs under your account. We may refuse, suspend, or terminate accounts at our discretion, including where we suspect fraud, abuse, or violations of these Terms.
4. Acceptable Use
You agree not to use the Service, and not to allow any third party to use the Service, to:
- Engage in fraud, identity theft, impersonation, or any activity intended to deceive or harm another person or platform.
- Circumvent the security or fair-use controls of a third-party platform, or violate that platform's terms of service.
- Harass, threaten, defame, or infringe the intellectual property or privacy rights of any person.
- Distribute malware, phishing content, spam, or any unlawful, deceptive, or harmful material.
- Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service or any connected systems.
- Resell, sublicense, or redistribute the Service or any temporary phone number without our prior written consent.
- Use the Service to receive communications you are not legally entitled to receive.
We reserve the right to investigate and take appropriate action — including suspension, termination, and reporting to authorities — against any User who violates this section.
5. Fees, Credits, and Refunds
The Service is offered on a prepaid credit model. Pricing for specific services and destinations is shown in the dashboard before you confirm a verification session. Credits are deducted upon successful SMS delivery. If a verification session does not deliver a code within the advertised window, the credit is automatically returned to your balance.
Except as required by law or explicitly stated at the point of sale, prepaid credits are non-refundable, non-transferable, and may expire after an extended period of inactivity. Taxes, where applicable, are in addition to the displayed price.
6. API Usage
If you access the Service through our API, you agree to comply with the published rate limits, authentication requirements, and technical documentation. API keys are personal to your account and must not be shared. We may revoke API access, throttle requests, or require additional authentication to protect the integrity and availability of the Service.
7. Intellectual Property
The Service, including all software, interfaces, designs, logos, and documentation, is owned by VerifyNumber or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved. You may not copy, modify, reverse engineer, or create derivative works of the Service except as permitted by applicable law.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect information. By using the Service, you acknowledge that you have read the Privacy Policy.
9. Third-Party Services
The Service interacts with third-party platforms, carriers, and eSIM providers. We do not control these third parties and are not responsible for their availability, policies, or content. Your use of a third-party service through VerifyNumber is subject to the terms and privacy practices of that third party.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that any specific verification will succeed, that any specific number will be available, or that any third-party platform will accept a temporary number.
11. Limitation of Liability
To the maximum extent permitted by law, VerifyNumber and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service shall not exceed the greater of (a) the amount you paid to VerifyNumber in the three months preceding the claim or (b) fifty U.S. dollars (USD 50.00).
12. Indemnification
You agree to defend, indemnify, and hold harmless VerifyNumber and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.
13. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violations of these Terms. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and dispute resolution.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which VerifyNumber is incorporated, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts of that jurisdiction, except where binding arbitration is required by applicable law. You agree to waive any objection to venue or jurisdiction in those courts.
15. Changes to These Terms
We may modify these Terms from time to time. When we do, we will post the revised version on this page and update the "Last updated" date above. Material changes will be communicated through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Miscellaneous
These Terms, together with the Privacy Policy and any order forms or additional terms referenced here, constitute the entire agreement between you and VerifyNumber regarding the Service. If any provision is found unenforceable, the remainder will continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them freely in connection with a business transfer.
